2. Who may use this service
- Parents and guardians only may register. You must be 18 years of age or older to create a LearnWise account. Children do not register themselves.
- Child profiles are created by the parent. When you create a child profile, you confirm that you are the parent or legal guardian of that child and that you consent to the child using the Service under your supervision.
- You are responsible for keeping your login credentials confidential. Do not share your account with people who are not members of your household.
3. The AI tutor — what it is and what it isn't
LearnWise uses an AI language model to power tutoring conversations. You must understand the following:
- The tutor is an AI, not a human being. It is software. It does not hold a teaching qualification and is not a registered educational professional.
- AI can make mistakes. Despite our best efforts to align the tutor with the South African CAPS and IEB curricula, it may occasionally provide an incorrect or incomplete answer. Parents should review session transcripts and use the "Flag this" button if they spot an error.
- LearnWise is a supplementary learning tool. It is designed to support homework and revision. It is not a substitute for qualified teaching, professional tutoring, or educational psychology services.
- The AI will not complete your child's work for them. By design, the tutor guides learners through problems rather than giving direct answers. This is a feature, not a limitation.
4. Acceptable use
You and your child may not use LearnWise to:
- Attempt to manipulate, jailbreak, or trick the AI into breaking its guidelines
- Submit content that is offensive, threatening, or harassing
- Share your account login with people outside your household
- Use the service for any commercial purpose without our written permission
- Attempt to scrape, copy, or reproduce the tutoring content at scale
- Use the service in a way that violates any South African law
We may suspend or terminate accounts that repeatedly or seriously violate these rules. We will give notice before doing so unless the violation is severe.
5. Child safety
The safety of child users is our highest priority. Please be aware:
- All tutoring sessions are stored and accessible to the registered parent. We strongly encourage parents to review sessions regularly.
- Our system monitors conversations for signs that a child may be in distress or unsafe. If such content is detected, the parent is notified. The AI is instructed to respond with care and to encourage the child to speak to a trusted adult.
- If you believe a child is in immediate danger, please contact the South African Police Service (10111) or the Childline helpline (116) directly. LearnWise is not a crisis intervention service.
6. Payments and subscriptions
[Describe your pricing here — e.g. "LearnWise offers a free trial of X days. After that, a monthly subscription of R[X] per child profile is charged..."]
- All prices are in South African Rand (ZAR) and include VAT where applicable.
- Refunds: If you are not satisfied within the first 7 days of a paid subscription, contact us for a full refund. After 7 days, refunds are at our discretion. This is in addition to your rights under the Consumer Protection Act 68 of 2008.
- You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. We do not charge cancellation fees.
7. Our content and intellectual property
The LearnWise platform, its design, and the curriculum content we have developed are owned by us. You may not copy, redistribute, or commercialise any part of the service without our written permission. Your child's tutoring conversation content belongs to you — we only use it to provide the service as described in our Privacy Policy.
8. Our liability to you
We do our best to keep LearnWise accurate, available, and safe. However:
- We cannot guarantee that the AI tutor will always give correct answers. Always encourage your child to verify important information with their teacher or textbook.
- We cannot guarantee uninterrupted service. We will do our best to notify you in advance of planned maintenance.
- To the maximum extent permitted by South African law, our liability for any loss or damage arising from your use of LearnWise is limited to the amount you paid us in the three months before the claim arose. This does not affect your statutory rights under the Consumer Protection Act.
9. Termination
You may close your account at any time by contacting us. We may suspend or close your account if you breach these terms, but we will tell you why and give you a reasonable opportunity to respond, unless the situation requires immediate action to protect a child or other users.
10. Changes to these terms
If we make significant changes to these terms, we will notify you by email at least 14 days before the changes take effect. If you continue using the service after that date, you agree to the updated terms. If you do not agree, you may close your account before the changes take effect.
11. Governing law and disputes
These terms are governed by the laws of the Republic of South Africa. If we have a dispute, we will first try to resolve it directly. If that fails, disputes will be referred to the courts of South Africa. You also have the right to refer complaints about our data practices to the Information Regulator.
